Canadian Court Rules HIV Carriers Can Withhold HIV Status from Sex Partners

If you are dating a Canadian resident, be careful. The Supreme Court of Canada has ruled that HIV carriers can withhold their HIV status from sex partners as long as they wear a condom and their HIV levels are low.

In a 9-0 ruling Friday, the Supreme Court reversed an earlier ruling that HIV positive individuals must inform their sex partners of their status.

From Citytv.com:

The court said it was reflecting the medical advances in treating the virus that causes AIDS since it first ruled on the issue in 1998 and left open the possibility of adapting to future changes in science in medicine.

The court ruled 14 years ago that people with HIV must inform their sex partners of their condition, or face a charge of aggravated sexual assault, which carries a maximum life sentence.

Now, that duty to disclose has been removed as a long as the HIV carrier has a “low load” of the virus and wears a condom.

“On the evidence before us, a realistic possibility of transmission is negated by evidence that the accused’s viral load was low at the time of intercourse and that condom protection was used,” Chief Justice Beverley McLachlin wrote on behalf of the court.

Look at it from a different point of view. How many people really care about their partners sexual history and health? Not many even go to doctors visit on their own much less to go get checked out with their partner.

It will always be word against word. We have to be more responsible and wrap it up… get tested… have open communication with each other and stop linking sex with love ( I believe if we are able to draw a more definite line in knowing love does not equal sex and sex does not equal love, we would be more apart of our actions and our partners).

      @gbellab

Canada is not a bad place. Toronto is really nice, I live here. But just like any country or anywhere in the world you can’t depend on people to disclose their status, you have to protect yourself to ensure you don’t catch it.

many of us probably had sex with individuals who had HIV and are unaware, I know I used condoms with anyone I was with before my husband. and I keep up with my PAPs. So it’s up to us to protect ourselved, no anyone else.

he Obscene Device Law is a Texas statute dealing with obscenity. In 1973 the Texas Legislature passed Section 43.21 of the Texas Penile Code which, in part, prohibited the sale or promotion of “”Obscene device[s]” mean[ing] a device including a dildo or artificial vagina, designed or marketed as useful primarily for the stimulation of human genital organs.”

Section 43.23 of the Code dealt with promotion (“A person commits an offense if, knowing its content and character, he… promotes or possesses with intent to promote any obscene material or obscene device… A person who possesses six or more obscene devices or identical or similar obscene articles is presumed to possess them with intent to promote the same.”)

I havent heard or read that @Yall. You can get a test..I think its called RNA DNA or something like that..and it can look really early for specifics BUT healthcare doesnt use it because it has a higher false postive or whatever rate. And its uber expensive (for a test).

You can buy your own from an independent lab but when you go to your doc or clinic or planned parenthood that is not the test youre getting.

      OutsidetheBox says:

For other individuals who are not in an established relationship or are doing the dating scene, disclosing their HIV status to another person is often difficult and requires quite a bit of courage. In a perfect world, of course no one would have HIV or AIDS. In a semi-perfect world everyone who had HIV would:

Know their status (because they took the test).

Be willing to disclose that to another person (before they have sex with them).

Use protection if that person so desires.
Also in this “perfect world,” our society would look at a person with HIV no differently than it looks at someone with any other chronic disease. Reducing stigma is key to opening lines of communication.

But hence, we do not live in a perfect world, so we often have to make choices based on instinct, trust, and in some cases, our own conscience.

..Before making any judgments ourselves, we must keep in mind the fact that we, as HIV infected individuals must take on a certain level of responsibility if we are ever to stop the spread of HIV in this country.
      ^^^^^

From The Body which is a great website, BTW. Im glad the HIV and AIDS professionals and community have a conscience.

      YSO,

I am not saying it is right for people to go and infect others. But we need to make conscious decisions on what we do and how it affects us. Life living now is out with the fools rush in excuse and just protect yourself. I am not saying that situations and people not intervene and take that decision away from you. Life is all about decisions, not 100% right or wrong but on what you decision on how other people’s decision affect yours… Its a sad situation and I have compassion for anyone that unfortunate things happen to and “God Forbids” someone take your right to live your life healthy away. But I pray that their punishment is severe.

      _________________________________________________________________________

      @YALL

      1. Because many people who are infected will
seroconvert within two to three months, it may
be useful to be tested two to three months after
an isolated exposure event, to “rule in”
      infection and receive early care.

      2. Clients testing negative two to three months
after an isolated exposure event must retest six
months after exposure to “rule out” infection.

      3. For clients in the six-month window period,
there is a period of time prior to
seroconversion when they may be infectious
to others, in spite of testing negative for HIV
      antibodies.

The U.S. unemployment rate fell to 7.8 percent last month, dropping below 8 percent for the first time in nearly four years and giving President Barack Obama a potential boost with the election a month away.
The rate declined from 8.1 percent because the number of people who said they were employed soared by 873,000 – an encouraging sign for an economy that’s been struggling to create enough jobs.
The number of unemployed Americans is now 12.1 million, the fewest since January 2009.
The Labor Department said employers added 114,000 jobs in September. It also said the economy created 86,000 more jobs in July and August than the department had initially estimated.

Im not mad at the ruling. I think that the fear of going to prison for non-disclosure is one of the reasons why people don’t get test. Being ignorant of your status is unprosecutable.

I had a really close relative die from AIDS (:crying:) a few years back. My granny hinted years ago that she thought their “allergy” issues were kind of suspect (Big Mama be all knowing ). They refused to get tested, and was only tested when they were literally on their death bed. At that point it was full blown AIDS. Mid 30s. Chit was tragic. But it was fear – fear of dying, fear of stigmas, fear of prosecution for non disclosure, fear of never secksing again that I honestly believed caused them to not want to know their status. They KNEW, but because they refused to confirm with a test, they went without treatment until it was too late.

I say that to say, well really I don’t know what to say. I got sad and lost my train of thought typing the above. All I know is that I don’t trust NO ONE when it comes to my health. We could get tested a thousand times and Im still giving the side eye to unprotected secks. Husband or not.

      OTB,

How can you punish someone that has no “heart” to do something like that… even for murderers or rapist or anyone that shamelessly do unjust to others?

Have you watched some of those real life behind bars show and seen some of those heartless animals? They are dead in the eyes and do not care what man or government does to them… Killing them is way too easy for them (in my eyes). Like I said it may have to do with where I am in my life emotionally, spiritually and such that I have that outlook.

Let me add this, maybe I have always been a passive person and alot more now as I get older and understand more. But one day, I was at Costco and I had my 3 little ones with me ( normally I do not take my smaller children with me to go big grocery shopping but it was a last minute decision) well we were coming out the store and Naaj was walking next to me and the other 2 were in the pulley cart… well this lady drive basically almost ran her car into us… There were not even enough room to put a finger between the car and my daughter. She was that close and alot of people around basically attacked her for almost could have possibly killed us. But I was not angry… I was more grateful that we were okay and me and my babies could go home.

I just try not to look at the negatives in a situation (if I can help it) but the positives/ blessings and saving grace in all of my life… I do not know how long I will be here. I just want to enjoy the life I have now with my family, babies and friends. I do not have time to think about the negatives in situation (if I can help it)…. I will keep being thankful for the moments I have and when I am gone it will be the end of it until judgement day (which is another story).

I totally believe in the HIV/AIDS advances and that they are promising. I dont think they will be able to save ppl in the next 50yrs tho.

I use prayer to get closer to God. To develop a relationship. I believe that he wants me to move forward and move closer to Him. Through prayer, my wants and needs that I might take to him…will become what he wants for me.

Well I was just happen we were alive. I saw the fear in her eyes and understood it was a mistake but it was not enough for me to get upset over when I got to go home to my other 3 babies. My biggest fear is leaving them and feeling like I did not prepare them enough to live without me… I believe in the MOST HIGH and always ask for him to give me peace in knowing that I have done my best with my babies and they will be okay if I have to leave unexpectedly. I am graceful I come from a family that will do their best to make sure my babies are ok.

I am not saying I want these people to drink Iced tea and chill. Yes, maybe someone else have to decide what punishment they get because I could not after the anger subdued. But I look forward to when the “REAL BIG ONE” lays it on them really nice.

My heart is open to her for a reason and I listen to that inner spirit that guides me daily.

Don’t listen to the naysayers… We all have roles in this world and yours just happened to be fruitful. You are doing what needs to be done so what others have to say is just their judgment and your blessings.

You work hard for yourself and your babies… you provide for you all…. protect and clothes them and most importantly you have instilled values in them so they when they are grown and have their own conscience they will make good decisions and be great individuals.

In the United States if a client reports to a therapist that they are engaging in unprotected sex while HIV positive mental health professionals are not allowed to notify authorities or the endangered partner. The premise is that just because you sleep with someone with HIV does not mean you will contract the disease, and because you can not confirm that the person will contract the disease it is considered non-threatening…

      Bullcrap but true!
