McDonald’s Lawsuit Claims Toddler Ate Used Condom
A Chicago woman is suing the McDonald’s corporation claiming her 2-year-old ate an item that wasn’t on the menu.
According to court documents, 2-year-old Jacquel “picked up a used condom that was on the floor” in the children’s play area of a Chicago McDonald’s. Then, the complaint alleges, the toddler coughed up a piece of the used condom.
The child’s mother, Anishi Spencer, claims her son, who is now 3, “has suffered severe and permanent injuries, both physical and psychological, as well as pain and discomfort.”
The complaint adds that the boy “will become liable for sums of money for continued medical care throughout his life.” The complaint also names Jacquel’s 4-year-old brother Jonathan, who Spencer said also handled the used condom.
She is seeking $50,000 plus attorney’s fees.
The complaint says McDonald’s Corporation and McDonald’s Restaurants of Illinois, Inc. “failed and neglected” to keep their restaurants clean of used condoms. But the lawsuit doesn’t mention the mother neglecting to monitor her own children.
McDonald’s USA director of operations Wanda Haltek said in a statement: “Providing a safe, clean environment is a top priority for us. This restaurant is no exception. These are just allegations and we strongly caution anyone from jumping to conclusions without having the facts.”
Haltek said she is still waiting for Spencer turn over the used condom for McDonald’s to examine.
“Because this is now a pending legal matter, it would be inappropriate to further comment or speculate,” she said.

The NY Daily News reported that Ms. Spencer, immediately took both boys to hospital.
Spencer, also says the chain did not use surveillance to uncover any “deviant activities” on its grounds.

“This is a very disgusting case,” Jeffrey Deutschman, a lawyer for Spencer and her sons at Deutschman & Associates in Chicago, said in a phone interview.
He said he tried to settle, but was unable to do so after having to deal with “layers and layers” of bureaucracy at McDonald’s, which is based in Oak Brook, Illinois.
The case is Hines et al v. McDonald’s Restaurants of Illinois Inc et al, Cook County Circuit Court, No. 2013L002625.

Why should McDonald’s settle? She has no proof that what she says happened really happened. Where’s the condom?
If the mom was as attentive as she says, seeing the child pick it up off the floor, she should’ve snatched it before he was able to chew it like bubblegum.

I always thought that the rubber would have gotten lodged somewhere and stopped his breathing-thats why you’re not supposed to let kids play with rubber balloons-they will bust them and eat/swallow them.

If she wants money she needs to produce the condom. It’s as simple as that. You expect a major corporation to take her word for it? The spokeswoman said they want to see the condom to examine it. The mom doesn’t have to give them the entire condom, just a part of it. It is important to her case to see if the condom really did pass through the child’s digestive tract, which we know it didn’t because he didn’t eat it.

I practically raised my nephew, and he played with plenty of balloons when he was 2. Yes, he put them in his mouth but he never once chewed one and swallowed it. It was hard enough for me to get him to eat a plate of green peas, much less a balloon. If the mom knew her child was that slow she should have kept an eye on him. McDonald’s has a sign up that says they are not responsible for your kids on their playground.

Sandra…something ain’t right here. I have a 2 year old. Where was the mother here..my son puts ANYTHING in his mouth I am right there. For him to swallow a condom he probably had it in his mouth for a while or chewed it.I think the mon should be somewhat liable here for negligence in supervising her child.
