A Milwaukee mother was accidentally shot and killed by her 2-year-old son who found his father's loaded weapon on the floor of the back seat on Tuesday.

Patrice Price, 26, was driving on a Milwaukee highway when the toddler picked up the weapon, pointed it at the driver's seat and fired. The bullet travelled through the driver's seat, striking Price in the back.

The car she was driving rear ended another vehicle and came to a stop on Highway 175 in Milwaukee. She was pronounced dead at the scene.

The condition of the other driver was not released.

“Initial witness accounts indicate that a child in the back seat of the vehicle got ahold of a gun and discharged the firearm, sending a single bullet into the driver’s back,” the sheriff's department said in a statement.

The mother-of-3 was driving with her two sons, ages 1 and 2, when she was killed.

The 2-year-old reportedly retrieved the .40-caliber handgun from the floor of the back seat behind the driver's seat.

The 1-year-old was in the front passenger seat. The children were not in baby car seats as required by law.

The dead woman's father, Andre Price, told FOX6 News his daughter was driving her boyfriend's car at the time of the fatal accident.

"I have a knot in my chest. They won't even let me see my daughter. I wanted to hold my daughter for one last time," he said.

The children's father was a security guard who failed to secure his weapon in his vehicle.

    My friends grandchildren are never fastened into car seats. They post those pictures on facebook with their children riding in the car free as day. When I say something I get the side eye like I'm getting out of my lane. The gun should've have been there. But if his butt was in his seat he couldn't have gotten the gun and if she buckled him in she would've seen the gun.

    The 2 year old was able to fire off a .40 without any trouble? How did she not hear him with it? Going to the gun range with one of my friends who owned a .40, she let me fire hers and I let her fire off my 9 mill. Let me tell you, it took a little bit of force to shoot it. My 9 is way smoother and easier to shoot, even with just 1 hand.

    True. Hard to imagine a 2 year old even getting enough of a grip on the gun to be able to pull on that trigger... even for a 9mm, much less a 40. (Makes me wonder if it's a Glock though. The Glock 23 40 caliber has one of the smoothest triggers. Most other 40's have kind of a stiff trigger.)

    Just one of those crazy freak incidents. Just reminds us how much of a blessing it is to see another day each day. So many crazy ways for a person to have their life cut short.

    I once watched a little girl unbuckle herself out of her stroller to point to a menu at white castle. Then she hopped herself back into her stroller and strapped herself back in. It took everything in me not to shake her big behind out the stroller and tell her to walk.

    But I think that ALL parents should subscribe to the 'no car seat/no riding rule' because this could have been WAY more deady. The kids could have been killed in a crash AND other innocent people on the road/sidewalks etc could have been hurt...

    Why should he get charged? He's an armed guard, which means he licensed to carry a gun for work. Did you just glaze over that part? No crime was committed , this was an honest mistake. I'm sure their father didn't think his gun FOR WORK, would slide from under his car seat and be used to kill the mother of his children. Now he should've had it in a lock box in his trunk. But I know for a fact he isn't the first or the only person to keep a gun legal or not under their car seat. I'm not going to tear their father apart for this horrible accident, I'm sure the man has enough on his plate right now.

    It's sad but I agree. People dropped the ball here. The father for not securing a gun in a car used to drive ur children around. The mother for not securing her children. A one year old in the front passenger without a car seat? Also, in securing them, I'm sure she would've seen the gun and moved it.

    That's what i was thinking. I've seen many cases where people have been charged in cases like this.

    Leaving a loaded unsecured firearm in a place where children can access it is considered a crime in many parts, if not all parts, of this country.

    I've sadly seen a mom not put their child in a seatbelt or car seat--my cousin went & purchased the other cousin one for this reason & sadly he STILL pops up from time to time (can see it on road trips)...my mom refused the front seat because she said she WOULDN'T want to see THAT (if anything happened)...You get a brand spanking new booster seat, advised by US to strap him in & YOU STILL DON'T...I'LL NEVER GET IT!

    She was charged with a misdemeanor because that's the law in her state ( Florida). She was given a slap on the wrist and should've known better. Unless there's a law like that in their state I dont think the father will get charged with anything. Children are nosey as hell and search through everything just to get what they're looking for. Hell some will even break then locks off just to to what they want.

    No car seats.....I would say might not have been able to afford them, but if you drive a car....you better find the funds or take your azz to a thrift store/second hand store and purchase one. SOMETHING IS BETTER THAN NOTHING!!

    With that being said. if you were unable to afford car seats, or perhaps were in someone else's car and din't have them with you......why not have them buckled in the back seat?

    Not very many 1 or 2 year olds can unbuckle the seat beat- the button is too hard for their little fingers to press with enough force to do it. So having them buckled in the back seat (definitely not the front), would have been a great way to secure them. This is so said and tragic and best believe their will be that one ratchet azzed, should have been swallowed or sucked the fukk out family member who will retell this story to this child......Lord, I don't want to wish death, but can you make them mute now?!

    I wouldn't necessarily advocate for a used car seat. Car seats and boosters have expiration dates on them, and if they have been involved in an accident, the integrity of the seat can be compromised. Many health departments and fire departments give them out for free.

    We traveled this way, but we would have to share a seat belt or one of the older kids held the younger ones. Even in the days when there was the bench seat in the front of the car, there was a middle seat belt to secure a child.

    Its crazy because I know if their mother survived the blame would shift to her for not having the kids in car seats. I'm not blaming their father for anything. Who's to say he never locked his gun up? Maybe just maybe she borrowed his car, and he forgot he had his gun under his seat. We don't know anything about this man, just what's being reported.

    I live in Milwaukee and this is shaking up our community and is a major wake up call. Very sad situation the victim mother was the passenger and one her kids was in the front seat with her, and the two year old was in the backseat and got a hold of the gun. Yes it was the boyfriends car who held some type of security or armed guard position and left the gun in the car obviously not secured properly. Same thing happened to a white gun toting mom few months back luckily she survived but GUESS who is getting charged with all kinds of stuff? The mother .That's right. A lot of commentors on others sites making comments about her because she is black but guess what this isn't a color issue at all. This is happening everywhere to everyone. Just have to be careful and secure your weapons point blank period.Especially around kids. R.I.P Patrice

    Do you have kids? Forgetting you have a loaded weapon in your car is not a luxury a parent has. Not having a car seat for 1 and 2 year olds is not responsible. Truth be told it's the mom and the fathers fault. I don't care if he locked up his gun everyday but that day. When you have kids, especially small ones, certain things you can't take for granted. This is one of them. He works with that gun everyday. How do you forget?

    I agree a little, as I am assuming that the lack of carseats meant they didn't usually ride in his car. Should he have had it in a lock box, sure, but if there was never an incident prior, it seems that he might have forgotten it was under the seat or thought she and her mother would buckle the kids in or something. This was really negligence on the mother and grnadmother's part.

    You don't know these people and are using you emotions to comment. How would you know if the man ever locked his gun up? Who's to say he didn't have car seats and they were taken out? You don't know and neither do I , which is why I'm not dragging their father. He's clearly not a criminal and has to live with this tragedy for the rest of his life. It was clear they loved each other seeing as how all the children had the same father. It's a sad situation all around but I'm not going to shit on the only living parent they have left.

    My grandson's father usually gets the seat from my daughter when he picks him up. Why hasn't he purchased one for his car.....I have no idea, but to be safe we make sure he takes ours. I don't know what happened here that she didn't grab carseats or buckle them in, but if he didn't typically drive them in his car...that would be the reason for lack of carseats and the gun under the seat.

    You don't have to have kids to be a parent, or to understand what its like to be one. I don't know why people with children assume that, I didn't raise myself. Its clear the kids didn't normally ride in their father's car. Which is more then likely why he forgot his gun there and why there weren't any car seats. Honestly this could have been avoided if their mother and grandparents were more responsible. You can't blame the mama cause she's dead, so I guess the fathers next in line.

    5 point harness carseats are hard as hell for an adult to deal with and you should purchase the carseat according to not only the child's size, but according to the child's proclivities.....I have a 4 year old cousin who still gets the 5 point harness cause his azz will climb out of the regular seatbelt, car seat set up.

As for the gun......I am going to think that he typically left it in the car, instead of in the house and felt it was safer out there so the kids could not touch it. I can't really say he was negligent, as if this was an emergency for her to use the car and he forgot or thought the kids would be buckled in.....he didn't used bad judgment and assumed they would not bother the gun. Especially if this never happened before. Now, I do side eye the hell out of the one who should have had the most sense!! THE GRANDMOTHER!!

    If anybody thinks that a two year old needs a lot of instruction on how to figure out a gun......you clearly have NOT been around these new toddlers!! They understand that a phone requires a password and I have seen one draw the unlocking pattern. My 4 year old grand has been downloading games from Google play since he was 3 and understood FREE meant- he didn't need me to get it. Yes, they know how to get our of carseats, which is why the 5 point harness was created. This child may have seen his father putting the safety lock on the gun or taking it off (hopefully not the 2nd) and that is all it took. We can say the father should have put it in the trunk, but I just cannot understand why grandmom didn't keep looking back to check on the 2 year old who was in the back seat alone....or didn't simply sit back there with BOTH the children for safety, since their carseats were not in the vehicle.

    Now a mother mourns the loss of her child, 3 children mourn the loss of their mother, a man is left to raise his children without their mother and a 2 year old will be forever scarred. And an innocent person, who was rearended has bee injured.

    My daughter knows better then to touch, go in closet or my purse without asking. But yet I still keep it locked when she's near.

    The hospital I use to work at security guards could not take their assigned weapon home. They signed them out when they got to work turned them in before leaving. If you hv a take home weapon and you failed to secure it properly seems like her family could sue him and the company.

    I'm sure he does have enough on his plate BUT if he's a professional armed guard why would he have a loaded pistol with one chambered and I'm guessing the safety off, cocked, just laying under his seat? In too much of a hurry to put it in the trunk? There's no way a 2 or 3 year old child could chamber a round in my .45 or even take the safety off!!! It takes some strength to load a round and pull the trigger with a hand that size.
