The lawyer for Usher Raymond‘s Atlanta accuser is throwing in the towel.

Attorney Lisa West filed a motion to withdraw as legal representative for singer Laura Michelle Helm, who filed a $20 million lawsuit against Usher for allegedly infecting with herpes.

Rumor has it that Helm fired West after trying to cut her own deal with Usher’s people. West reportedly represented Helm pro bono (free of charge).

The motion, filed on Thursday in Fulton County Superior Court, said West could “no longer effectively represent [Helm] in this case as her ability to do so has been irreparably harmed.”

West added that Helm has consented to her withdrawal from the case.

Helm, 32, accused Usher of infecting her with the herpes simplex virus when they allegedly had unprotected sex in April.

In her lawsuit, filed in Fulton County in July, Helm insisted Usher did not wear a condom during a 2nd sexual encounter in her hometown of New Orleans in April.

But a recently uncovered recording disputes her allegations that the 38-year-old singer had sex with her without a condom.

In the recording, obtained by TMZ Helm tells her former publicist, Dennis Byron, that Usher did wear a condom during their sexual romp in New Orleans earlier this year.

Helm said Usher had always worn a condom when they had sex, so she wasn’t concerned about being exposed to the herpes virus.

Helm is heard on the audio tape saying, “That’s why they make protection, for people who have STDs.”

Legal sources say that, in light of the damning audio — and other unreleased TEA — West had no choice but to withdraw from the case — or be the laughing stock of the Atlanta legal community.

Byron tells Sandrarose.com exclusively that he plans to sue West and Helm for defamation and harassment after they dragged him into court earlier this month.

Helm and West filed a restraining order against Byron to prevent him from releasing any more evidence that proves Helm may have lied about contracting herpes from Usher.

During the nearly 3 hour hearing, West accused Byron of selling information to a certain Atlanta blogger. But magistrate Tamika Hrobowski-Houston threw out the restraining order for lack of evidence.
