Usher and Tameka Raymond in court

Moments ago, Judge John J. Goger denied Tameka Raymond's request for primary custody of her two sons with singer Usher Raymond.

After the judge gave his decision, Tameka and Usher hugged in open court. Tameka filed for an emergency hearing on Tuesday after one of her sons nearly drowned on Monday.

Both Usher and Tameka took the stand saying the other was unfit to raise their 2 children, Usher Raymond V and Naviyd Ely Raymond, 4.

But after hearing from both sides, Judge Goger let stand a previous judge's order giving Usher primary custody of his kids.

Usher and Tameka Raymond in court

Singer Usher Raymond smiled as he arrived at Fulton County Courthouse court in Atlanta, Georgia earlier today to face his ex-wife, Tameka Raymond, in a new child custody battle after one of their sons nearly drowned in a swimming pool accident Monday.

Five-year-old Usher Raymond V, aka Cinco, is still recovering at Children's Healthcare of Atlanta Hospital, according to the Tameka's lawyer, Lisa West.

Tameka took the stand this afternoon and said she was concerned there was no pool drain cover installed in the pool as required by law. She said there have been other incidents -- in addition to Cinco's near drowning this week -- that prove Usher is a bad dad.

Tameka also expressed concerns that Usher's aunt, Rena Oden, was incapable of caring for the 2 boys. Cinco almost drowned at Oden's house on Howell Mill Road in DeKalb County, north of Atlanta.

Tameka Raymond Usher Raymond Judge Goger

This email came from a credible source within the Fulton County courthouse. The email concerns Fulton County Superior Court Judge John Goger who is presiding over Tameka Raymond's emergency hearing to request custody of her 2 sons with Usher Raymond.

Usher and Tameka's 5-year-old son, Usher Raymond V, nearly drowned in his aunt's swimming pool on Monday.

Usher Raymond V, aka Cinco, is still recovering in an Atlanta area hospital. The boy inhaled chlorine water into his lungs and required respiratory support when he first arrived in the ICU.

Yesterday, Tameka tweeted a photo of herself holding Cinco in his hospital room.

In the caption she wrote:

My favorite 5 year old. What a blessing! I have always loved and appreciated my sons but tragedies and close calls make this even more evident. URV had an angel named Kile Ishmael and our Lord and true savior to look after him. Words cannot express the relief and how thankful to God I truly am. Thank you Jehovah God, Jesus and Kile...also The AV worker that saved my son is my Hero!!! Period

Judge Goger is the same judge who returned a girl to her millionaire father after the father was arrested twice for abusing her.
