Kim Zolciak’s son, Kroy “KJ” Biermann Jr., 15, remains in a juvenile detention facility after his court hearing on Tuesday, Sept. 8, was cancelled suddenly.

A north Georgia grand jury indicted KJ on seven felony charges following an incident with a 15-year-old girl at a gym in April, when he was 14.

KJ’s attorney, Jason Sheffield, said the preliminary hearing was cancelled because the presiding judge will be changed.

“Because the State indicted my client, the judge who would have presided over the preliminary hearing today has been divested of that authority,” Sheffield told Page Six exclusively.

“We will have several court dates coming up, including a motion to transfer the case to juvenile court, a bond hearing, and an arraignment on the current indictment.”

Sheffield said KJ’s next hearing is scheduled for October 14.

He explained that the state intends to try KJ as an adult, which was the matter to be heard at Tuesday’s hearing.

“We are expecting to enter not guilty pleas to all charges at the plea and arraignment hearing on October 14,” Sheffield said outside court.

He said he will file a motion to transfer the case to juvenile court, where KJ has more rights as a minor.

“I’m going to file a motion for the case to be transferred to juvenile court and for him to be tried as a juvenile,” he told Page Six.

“Unfortunately, we will have to wait for our day in court where we can finally begin to level the playing field.”

The reality TV star recently declared KJ is innocent and he passed a lie detector test.

KJ is currently being held at Atlanta’s Metro Regional Youth Detention Center (Metro RYDC) since his Aug. 17 arrest.

His mother, Kim, visits him often at the facility. KJ’s sister, Brielle, accompanied her mom on one visit, according to Page Six.
