“The View” host Sunny Hostin cited New York state law in her defense of 7 Cornell University frat members who allegedly s*xually assaulted a woman in 2024.
The woman, identified as “Jane Doe” in a civil lawsuit filed against the university, told police she voluntarily drank alcohol, used drugs and engaged in s*xual acts with the frat members.
On Tuesday’s episode of The View, Hostin held up the 9-page statement written by “Jane Doe” in 2024. Hostin noted the woman admitted to drinking and snorting ketamine at the frat house.
“She voluntarily drank a lot, she voluntarily snorted ketamine,” said Hostin who noted that the woman had made plans to meet one of the men at the frat house on campus.
Hostin, a former New York prosecutor, said, “Under New York law, voluntary intoxication or drug use that merely impairs judgment does not legally constitute an inability to consent to se*ual activity.”
Hostin’s co-hosts peppered her with questions about the woman’s level of intoxication. But Hostin repeated the law that states voluntary intoxication does not inhibit a woman from consenting.
“That means if you voluntarily ingest drugs, you voluntarily take alcohol, you can agree to have threesomes,” Hostin said.
“In her statement, she agreed to have two separate threesomes. One boy did walk in- one young man did walk in and say everybody out! So there was one person that did that. According to her statement, three of the young men did not touch her.”
Hostin said pictures of the Cornell 7, who were not charged, are plastered all over the Internet and she thinks people are reporting the story “inaccurately” and “unfairly”.
“While this is something that we have to take very seriously, there is no way, according to her statement in 2024, that any prosecutor would’ve brought [charges].”
Hostin continued: “In 2024 she said one thing, and now in 2026 she’s saying another thing.”
