The NAACP is formally protesting the sentences of two white women, alleging race bias because the two wmen didn’t receive the same sentence as their black co-defendents.
The Cobb County women, dubbed the “Barbie Bandits” by the media, were arrested for robbing a Bank of America branch in February, 2007. The heist involved four people: the two women, a black male teller who worked in the bank, and a black male who introduced the women to the bank teller.
The two women received the following sentences for their roles in the bank robbery:
- Heather Lyn Johnston, 20, and Ashley Nicole Miller, 19, both pleaded guilty to theft- by-taking charges. Miller received two years in jail, followed by eight years probation. Johnson got 10 years probation. (Source)
I agree that the women’s sentences should have fit their crime since they weren’t forced or coerced into robbing the bank. But the prosecutors took into account their ages, their lack of criminal records at the time of their arrests, and their willingness to cooperate with the investigation.
Now let’s look at the brothers: Bank teller Benny Allen III, 23, (pictured above) was sentenced to five years in prison. He told the women what to write in their bank note and he handed them the money (almost $11,000). Allen was already on probation for a drug offense when he was arrested, and prosecutors say he refused to cooperate with authorities.
Michael Chastang, who introduced the women to Allen, received the most severe of the four sentences. He was already on probation for a prior drug trafficking conviction and he was ordered to serve out the 15 year sentence he received for that conviction.
Was the judge supposed to ignore the fact that both men were already out on probation for serious drug offenses? Doesn’t the NAACP have anything else better to do with its time?

I agree with you on this one, Sandra. Let’s ignore the criminal records for a moment, though, and focus on the fact that the women cooperated. Cooperation goes a long way in the criminal justice system. It is how the government builds cases. These women cooperated and told them everything they needed to know about the two men. Perhaps if the teller had cooperated (or, snitched, as many people call it), he wouldn’t be facing the time he is now.
I won’t go so far as to say that the black mens sentence was unfair but I do feel that the white women were given a VERY light sentence!!!I dont care how old they are or how much trouble they havent been in, they deserve more time than what they were given. Im more upset at the fact that Bank of America (who I bank with) is letting people w/ prior convictions work for them and be around my banking information!!! The NAACP is wasting their time. The black men had ALREADY been in trouble before…what do they expect? I could see if there was another black woman w/ them who had no priors and they gave her a harsher sentence than the white girls. They need to go sit down somewhere. The next race issue that comes up ppl wont even pay attention if they fight for this nonsense!
Very interesting scenario. I remeber seeing a one of those ABC specials where they interviewed these girls. It was such a casual interview.
The problem for the NAACP is that the black guys all had prior offenses. It’s common knowledge that people punished less when they have no prior convitions.

Look at the story of Andrew Butler and Christopher Avery. Both college students. No prior offenses, yet they were both sentenced to 20 years. No rehabilitation or anything. Just two more black men off the streets and into prison.
Yea the NAACP need to “GET SOME WHERE AND SET DOWN” Don’t be trying to get every BLACK Tom, Dick, and Harry out of jail time just because their BLACK. Some of these idiots deserve to got to jail and learn their lessons. The NAACP is starting to lose credibility over their bogus accusations, if they keep this up, they won’t be able to help those in REAL need of civil rights.

I was going to bring up that same incident. I don’t know where you’re from, but I know Andrew’s mother personally. I used to work with her back in the day. She has a very kind spirit. I felt sorry for them (Andrew and Chris), these guys didn’t rob a bank to get rich. They robbed a bank to stay in school. It was unfortunate that they went through any means necessary to do it. But I applaud the fact that they were so determined to stay in school that they went as far as robbin’ a bank. Now thats what I call “gangsta”.
But onto these two meth lookin’ crack whore chicks and their pimp. All I can say is that’s some b u l l s h i t!
The NAACP doesn’t have anything better to do besides read this here blog and go after criminals for doing criminal behavior? Can they help some black folks lower some interest rates and qualify for a house, a car, lead a march down a block somewhere….this is no longer the NAACP my grandparents talked about.
If you look at it, the dudes do the time and get out. These girls are young—8 and 10 years on probation ain’t a walk in the park. Chances are, they will get another offense and THEN they go up the river without a paddle. It’s really a set up if you look at it. The judge can charge them with the new crime and sentence for both. What is the likelyhood of them living model lives for the next 10 years on paper?

Yeah, it might be nice if the NAACP could help lower interest rates or help people qualify for a house, but the banks (those rich white people Jeremiah Wright was speaking about) don’t have any concern for ‘helping the poor man.’ The only thing they’re interested in is ‘making money off of the poor man, and keeping him poor.’ This is how all these ‘subprime’ loans got out there in the first place, causing this entire economic MESS we’re in right now.

Great point. 10 years is a long time. They could forget to renew their drivers license and get pulled over for speeding. That little bit of trouble could cost them dearly. They could leave their child in the car for a mega second becasue they forgot something inside their own home.
C’mon these girls were on 20/20 acting like it was no big deal. They are still young and will do something stupid. They are white girls. Girls gone wild ring a bell. Do you think mommy and daddy are going to lock them in the basement for the next 10 years so they don’t so much as sneeze in public. Actually Nicole the 19yr old got 2 years jail followed by 8 yrs probation.

Hold up. How can you work for a bank and be on probation? In Canada, you cannot have a criminal record (that hasn’t been expunged) and work for a financial institution (or cash chequing place for that matter). Further, all major banks give employees 48 hours following an arrest to report it to human resources. Depending on the arrest/charge you may be terminated immediately. You might get lucky if it something like DWI, but most people don’t make it. And they make you sign this contract before your hired, so you can’t even claim ignorance. If you are arrested for anything and don’t report it, it is automatic dismissal.
But race my not be a factor in the case of the employee. As an employee of the bank he is privy to insider information, which he clearly used to assist the girls in robbing the joint. In Canada, employee theft is always treated harsher than shoplifting because there is an element of trust employers give to you. I have no pity for him. He just made it harder for other blacks (especially those with prior records) to get jobs at his and other financial institutions. And for what a cut of $11K? That is one short sighted idiot. While he sits in jail for 5 years, I hope he realizes that he could have made that working at McDonalds -and their uniform is far less itchy than those prison issues he’ll be sporting.
Aside: when you violate probation don’t you have to then do the sentence? So their previous convictions coupled with the new crimes, doesn’t that explain the prison terms?
That bank teller is a fool. I know plenty of people with drug arrests who can’t get a decent job. Here this idiot gets one and he blows it. If it will make them and the NAACP feel any better, I have a white elderly former coworker who was sentenced to more than five years for robbing a bank and it was her first offense. I think she had a gun though, but still they didn’t take her mental state into consideration or anything. The moral of the story is don’t break the law and you won’t have to worry about this sh*t.
I just read some of the comments and the reason Andrew Butler and Christopher Avery probably got so much time is because it was an armed robbery. Guns can add up to 10 years to any sentence. I know more than one person who received lengthy sentences on first offenses because they were armed. I even know someone who got 14 years for stealing cheese and crackers from a convenience store while armed with a realistic looking water gun as a prank. As long as the victim thinks the weapon is real it’s considered and armed crime.
