Over the weekend I received numerous emails and phones calls from fellow bloggers and non-bloggers expressing concern and encouragement.

Update:

Earlier I wrote that not one female blogger was among them. But I was wrong. Blogger K.I.M., who is also an industry veteran, did write a post in support. Thanks to longtime member Attorneymom for pointing that out.

Dennis Byron, Editor-in-Chief of Hip Hop Enquirer, points out that JD’s punk azz made terroristic threats from outside of the United States’ jurisdiction (he was in France) — probably under the false belief that it was legally OK for him to do so.


LEGAL MINDS CHIME IN ON HOW THE LAW CAN HANDLE THESE TYPE OF THREATS

Prominent Atlanta Criminal Defense Attorney Larry Ellerbe who has been an analyst in the past on other crime related stores hand this to say:

It appears that everyone is disturbed over the allegation of Jermaine Dupree threat to blogger, Sandra Rose. I am not here to weigh in on whether the alleged statements are legally actionable because I was not there. What I can do is give you a legal perspective as to what is required to be considered a terroristic threat. I believe an informed reader can come to the conclusion if Jermaine Dupree is in jeopardy of legal consequences. So what are the elements of a terroristic threat?

1. Someone willfully threatens to commit a crime that will result in death or great bodily harm. Usually threatening someone property does not rise to the level of a terroristic threat unless you are connected to said property and you obviously will be harmed by its destruction.

2. The threat was made with the specific intent that it be taken as a threat. This means that if it appears that you do not have the means to carry it out but you made the statement with the intent that the person believes you can carry it out it still classifies as a threat.

3. The threat is so unequivocal, unconditional, and specific as to convey a gravity of purpose and immediate prospect of execution. What this means is that the threat states what you will do and not what you can do. Ex. I can blow your car up if I get a bomb as oppose to I will blow you car up when I get the bomb. See the difference?

4. The threat actually caused fear in the victim. The person must actually believe the threat. Is this the case with Sandra Rose?

5. The fear was reasonable. If someone tells you that he/she is going to shoot you with a ray gun they just invented then it is unlikely you could take this threat seriously.

Keep in mind each state has it rules that constitute terroristic threat. Consider the alleged [threats] made [by] Jermaine Dupree, weigh it against the elements needed to be considered a threat and you make your own decision without listening to someone else’s opinion.

Now there still lies the question of if the alleged threat was made outside of the United States does the U.S. still have jurisdiction to prosecute the charge?

The answer to the question is not a simple one but what is important to note is that anytime a violation of the law is done via the airwaves and/or internet it becomes interstate, intrastate or an international matter. It may become a federal matter and thereby jurisdiction will not become a hindrance to prosecution. Also note that also the alleged threat may have been made in France the alleged recipient of the threat was in the U.S. which may give rise to U.S. jurisdiction to prosecute said threat. Thus may become an interesting matter for the Attorney General of the Northern District to decipher.




Sandra Rose says JD Threatened To Kill Her

So I just checked Sandra Rose’s site, which I happen to like. I don’t post gossip but I do check her out daily for my dose of it sprinkled with comedy the way that only she can deliver it. Yesterday she posted an article with many references from Creative Loafing about the fall and resurgence of Jermaine Dupri’s career. If you know Sandra you know yes she went “in” but you don’t expect any less from her.

Today she posted a blog about JD calling her and threatening her life all the while expressing that he wasn’t “threatening” her life. My thing is this and I’m not defending Sandra’s blog but I will say there were a lot of “truths” in her article, where the hell do these so called “men” get off on threatening, attacking and/or trying to intimidate women?

You got fools on the internet attacking Kat Stacks and reveling in the notoriety. You have men that abuse and beat women and if you believe Sandra now you have men calling women and screaming in the phone at them like women. This mess has got to stop, that shit’s not man like, it’s female, it’s not even gender specific, it’s bitchy, petty and sad. Can a real man please step up and school these boys on how to be men!

Smh, I thought being emotional was a female trait.

Hello, my name is Michael (AKA 6 Minutes) and I’m a loyal reader – and have been, silently so, ever since your Blogspot days – and having discovered your blog in 2007, I have been reading it every day since then. I run a blog called Chop It Up mag.com, which is actually an extension of the Southern Hip Hop/R&B magazine I’m currently preparing for market. Its only a month old but its growing fast. I count you as an inspiration for what I am doing as a writer/blogger – and that comes from the heart.

That’s why I was so bothered by yesterday’s JD post. I wrote a post about the incident as soon as I heard about it because I guess other bloggers were too busy overcoming hangovers yesterday to hear the frightful news and post on it. Anyway, if artists think they can intimidate bloggers and writers, they are wrong! And I’m glad you put it all out there for the world to see.

Blogs are about observations and opinions. Its all about sharing viewpoints, ideas, and impressions. If any public personality is so sensitive that they resort to threats of homicide over a blog post, then that person might need to consult a psychotherapist, or perhaps enter a not-so-public field of endeavor.

When will artists and producers recognize that any form of media will have en element of personal opinion infused into it? And at the end of the day, if you are someone who has been raised up and nurtured in the ‘biz’ all of your life, why be so sensitive? READ MORE…

MADDNESS FACTOR: Jermaine Dupri actually toke time out of his busy schedule to call in a hit on Sandra Rose, (Sandra Rose.com is a very popular urban blog, which highlights negative opinions of industry celebs). His behavior was unprofessional and just Ghetto! Although, Jermaine Dupri was not the only person to physical threaten Sandra Rose (flashback [to] 2005-2007ish), Usher Raymond confronted Ms. Rose during her paparazzi days at an industry event, nearly inciting a domestic violence case! LOL Fast Forward [to] 2010 and Jermaine, who is actually smaller than the petite Sandra Rose, feels that he can do the same. hmm, I wonder if Usher advised Jermaine Dupri on this matter! … Sandra! ..TAKE HIM TO COURT! ..Can we say restraining order?

Hey Sandra,

I’m Robin, a huge fan. I love your site and I visited at least 10 times a day lol. I just ready your post about your conversation with Jermanie Dupri. My jaw dropped. I couldn’t believe someone would say that to you or anyone for that matter! If I were you I would press charges. I’m not one to be afraid of threats, I personal believe that if someone was going to do something they would be doing it instead of claiming they are going to do it, but I think someone needs to show him he don’t run s***!

Obviously he was just mad because the truth came out, some people just can’t handle the truth and his reaction to you showed his immaturity and insecurity. You even mentioned that he didn’t deny anything you said in a previous post about him which to me says he is just hatin’ and he knows what you were saying is accurate. Honestly Jermaine Dupri isn’t anything to be worried about.

I don’t fear those who say they are going to have other people do their dirty work, if he is so big and bad why didn’t he threaten to do anything himself. I can’t help but laugh at this little man.
