What IS illegal is having classified information on that server, sharing that information with others who are not authorized to read that information, using one’s position as Secretary of State to use her office to direct funding to the family foundation in exchange for state contracts, using a private server to avoid FOIA laws, destroying government documents, etc. etc, etc, etc. etc.

First, there is no category called classified, it’s CONFIDENTIAL, a clever play on words that Hillary has clearly fooled you on. There are several levels of confidential, and if it’s not categorized it is the responsibility of the person(s) handling the information to KNOW why they are doing with the data. There is no such thing as classifying confidential information after the fact. It’s either confidential or not, and that information classified as such is the subject of the investigation.

Second, on the day she was sworn in as SoS the Wh0re of Babylon was briefed by the FBI on the protection of confidential information and SHE SIGNED AN OATH she would protect it. Obviously the FBI has already convened the Grand Jury because to offer Pagliano immunity means the GJ has been empaneled and a Federal Judge signed off on the immunity deal.

The FBI and DOJ, when they do their job, they look into stuff like what Mukasey says. They might look into more than just what he mentioned too.

He has set out what he views as apparent wrong doing. Why would law enforcement not see the same things themselves? I believe they will. I believe they will look into the things that he is talking about (probably not just because he mentioned it but because they have an eye for the law like he does) to see if anything is there with all the apparent bad things and pursue all avenues to come to a fair conclusion about all of this. They could come up with more apparently bad things too.

In the end, maybe they can’t prove somethings and the other things were not illegal. There may not have been criminality and/or provable criminality. Then again there is no reason to believe that.

They might want his testimony because he can help them paint the picture they want to paint in a trial or to a grand jury or both. Even if they didn’t or don’t get any kind of good info from him, it was well worth a try if you are going to the top of the pyramid, I’d say. Then again, they could be forcing him because they think he did something at least minorly wrong.

It’s hard to know what really is going on with all of this but I’m not going to be surprised if there are charges brought.

Everyone is assuming that this guy is being given immunity to rat out Hillary but Hillary has an entire staff any of whom could have ordered the deletion of the emails or whatever illegal supposedly happened (emails were hacked).
It doesn’t seem they are trying to get Hillary for the obvious if they need the testimony from someone who involved so badly that he was given immunity although the feds like to pile on the charges so they can get a plea deal instead of going to trial.

Where is there evidence that Clinton moved classified information from a secure server to a non-secure server?

The proof is in the emails. She apparently shared her State Dept password with staffers so they could access information and cut/paste it into emails for her. This password grants access to some of the top classified networks in government, including access to things like names and movements of undercover agents, etc.

Sharing the password is a federal crime. Copying info from a classified server to a private server is a crime each time it is done… Apparently it was done over 1000 times.

Using a private server also knowingly shielded her information from any Freedom of Information Act request; also a federal crime.

This is a much, much bigger deal than her supporters will admit. Anyone else would already be in jail as these are federal crimes. They are being extra cautious with her because of the implications if she is indicted. The immunity deal is not a good sign at all. There is a reason the White House is keeping their distance.

I may have oversimplified by saying it was cut/paste. The implication from the ‘unnamed source” was that the staffers accessed classified briefings using her password and summarized the briefings into emails for her.

Just the act of giving them her access information is a serious breach of security. But there is little doubt that the FOIA was violated by keeping information on a private server.

I had a relative who worked at the IRS who was threatened with 10 years in jail for accessing his daughter’s tax return (she thought she made a mistake and paid too much). The rules are obviously different for regular people versus political heroes.

I am take what people like Mukasey says seriously. Regardless of if he is a conservative and doesn’t like her, he knows about things that are legal, being the former AG. I don’t see anyone try to argue successfully against him. Bury her under a jail, or it’s just GOP attacks is most of what I hear.

If you look at his list of 4 things he talked about, it makes it complicated. One thing I can before is that the government don’t really need him to charge her with one of the things they wanted to. They just want to hammer the evidence down to make it look politically on them.

We don’t know if the material that was sent was actually classified. Supposedly it was a list of ‘talking points’.

If it was this would be a serious issue for both Sullivan and Clinton.

One of the complications of this mess is that Clinton herself as Secretary of State is the primary authority to make decisions on what should be or should not be classified.

1) they did not show that the server was never attacked. They said that Ms. Clinton did not click on any of the phishing links. Very different. Hackers would go through the back door, not the front door. Just learn her IP address, and take what you will without being discovered. That “leak” was so stupid it must have come from Camp Hillary.

2) I saw the email where Jake Sullivan was told by Clinton to send her a document on the classified server. Sullivan replied that he couldn’t. Clinton told him to remove the security headings and send unsecure.

3) I’ve seen the one that detailed an amabassador’s travel plans, three days before he was killed.

4) The Washington Post (a Dem Paper) said that 25% of those emails deemed classified originated with Clinton herself. She should have marked them classified. She understood what classifications mean and signed a form stating that after being educated by the FBI about her responsibilities when it comes to national security. She didn’t follow the law.

Overclassification has been generally known to be a severe problem in the US for a long time. It’s been an issue since the 1940’s.

For example the 9/11 commission blamed overclassification as one of the main reasons intelligence agencies failed to share information that could have prevented the disaster.
