President Trump took to Twitter on Tuesday to celebrate a federal judge throwing out Stormy Daniels’s defamation lawsuit against him.
Daniels, an exotic dancer, claimed she had an affair with Trump in 2006. She sued Trump earlier this year, saying the President defamed her on Twitter.com.
She also asked the judge to toss out a nondisclosure agreement because Trump never signed the document.
But on Monday, Los Angeles Judge S. James Otero found that Trump’s tweets were protected under the First Amendment.
“Mr. Trump’s tweet is a non-actionable opinion that cannot be the subject of a defamation claim. The First Amendment protects this type of rhetorical statement,” the judge ruled.
Judge Otero also ordered Daniels to pay Trump’s excessive legal fees.
Rather than take the high road, the U.S. President taunted Daniels on Twitter.com, referring to her as a “Horserace” and Avenatti as a “3rd rate lawyer.”
“Federal Judge throws out Stormy Danials lawsuit versus Trump,” Trump tweeted gleefully.
“Great, now I can go after Horseface and her 3rd rate lawyer in the Great State of Texas. She will confirm the letter she signed! She knows nothing about me, a total con!”
Daniels clapped back, referring to the “tiny” size of the President’s genitals, and she joked that he was into bestiality.
Daniels was paid $130,000 hush money by Trump’s former attorney Michael Cohen before the 2016 election. He plead guilty earlier this year to making illegal contributions to Trump’s campaign.
Cohen also plead guilty to eight counts of tax evasion, bank fraud and campaign finance violations — including another payout to a woman who claimed she slept with Trump.
