Update: Kodak Black’s lawyer slammed the U.S. Justice Department for offering Hunter Biden a sweet plea deal in exchange for pleading guilty to federal tax crimes and a felony gun charge.
Hunter’s plea deal means no prison time and no felony convictions on his record.
“There’s no such thing as not getting jail time on a gun charge on any kind of gun charge,” said Bradford Cohen, criminal defense attorney for Kodak Black, in an interview with Fox News Digital on Tuesday.
Cohen said his client wasn’t lucky enough to get the same sweet deal for committing the same crime. He said Hunter’s apparent slap on the wrist means there are “2 tiers of justice” in America.
“I’ve never seen anyone where this offense was charged, and they didn’t get some sort of prison sentence,” Cohen told Fox News Digital. “And in fact, most of the time in federal court, you very rarely see people get anything but a prison sentence.”
“A federal crime is supposed to be a federal crime,” Cohen continued. “And federal crimes are supposed to be very serious federal crimes, and that’s why you look at prison sentences.”
Cohen wrote on Instagram: “2 tiers of justice? Kodak was charged for the same crime. Got over 3 years. Mr. Biden will not serve a day. Feels right? Do FBI agents and federal authorities take cases personally?”
In 2019, Kodak Black was sentenced to more than three years in federal prison after pleading guilty to falsifying a statement on a gun registration form — the same crime Hunter Biden will plead guilty to.
Black was freed from prison when then-President Donald Trump commuted his 46-month sentence in 2021.
Other Black celebrities who served time in prison for similar crimes as Biden include Lil Wayne, Lauryn Hill, Ja Rule, Wesley Snipes, and Chuck Berry.
Hunter, 53, is expected to plead guilty as part of a plea agreement, according to the Department of Justice on Tuesday.
The guilty plea will end a years-long federal investigation into his tax crimes, according to reports.
Hunter also agreed to plead guilty to felony possession of a gun by a drug user.
The plea agreement will nullify the combined weight of the charges and Hunter will not see any prison time.
“Hunter will take responsibility for two instances of misdemeanor failure to file tax payments when due pursuant to a plea agreement,” said his attorney, Christopher Clark. “A firearm charge, which will be subject to a pretrial diversion agreement and will not be the subject of the plea agreement, will also be filed by the Government.”
Hunter and his father, Joe Biden, have been under investigation by the House GOP for a plethora of wrongdoings, including allegedly accepting millions of dollars in bribes from Ukraine.
“I know Hunter believes it is important to take responsibility for these mistakes he made during a period of turmoil and addiction in his life,” Clark said. “He looks forward to continuing his recovery and moving forward.”
Hunter is the second son of Biden and his first wife Neilia Hunter Biden.
