If you are dating a Canadian resident, be careful. The Supreme Court of Canada has ruled that HIV carriers can withhold their HIV status from sex partners as long as they wear a condom and their HIV levels are low.
In a 9-0 ruling Friday, the Supreme Court reversed an earlier ruling that HIV positive individuals must inform their sex partners of their status.

The court said it was reflecting the medical advances in treating the virus that causes AIDS since it first ruled on the issue in 1998 and left open the possibility of adapting to future changes in science in medicine.
The court ruled 14 years ago that people with HIV must inform their sex partners of their condition, or face a charge of aggravated sexual assault, which carries a maximum life sentence.
Now, that duty to disclose has been removed as a long as the HIV carrier has a “low load” of the virus and wears a condom.
“On the evidence before us, a realistic possibility of transmission is negated by evidence that the accused’s viral load was low at the time of intercourse and that condom protection was used,” Chief Justice Beverley McLachlin wrote on behalf of the court.

Canada is not a bad place. Toronto is really nice, I live here. But just like any country or anywhere in the world you can’t depend on people to disclose their status, you have to protect yourself to ensure you don’t catch it.

In a perfect world, of course no one would have HIV or AIDS. In a semi-perfect world everyone who had HIV would:
Know their status (because they took the test).
Be willing to disclose that to another person (before they have sex with them).
Use protection if that person so desires.
Also in this “perfect world,” our society would look at a person with HIV no differently than it looks at someone with any other chronic disease. Reducing stigma is key to opening lines of communication.
But hence, we do not live in a perfect world, so we often have to make choices based on instinct, trust, and in some cases, our own conscience.
..Before making any judgments ourselves, we must keep in mind the fact that we, as HIV infected individuals must take on a certain level of responsibility if we are ever to stop the spread of HIV in this country.

I know someone with HIV and doesn’t disclose to ppl. I however have gone behind their back and told the person they were trying to get with. I felt it was my responsibility.

how is it lessened especially if statistics are still coming out stating the rate of HIV cases are steadily climbing…obviously the laws here are not preventing anything…I had a professor tell me once if you break up with someone and need an order of protection, it’s not gonna help cause if the person was sane an order wouldn’t be needed…again I’m not disagreeing with the law we have here but I’ve yet to see what it has accomplished

Im not mad at the ruling. I think that the fear of going to prison for non-disclosure is one of the reasons why people don’t get test. Being ignorant of your status is unprosecutable.
I had a really close relative die from AIDS (:crying:) a few years back. My granny hinted years ago that she thought their “allergy” issues were kind of suspect (Big Mama be all knowing :yes:). They refused to get tested, and was only tested when they were literally on their death bed. At that point it was full blown AIDS. Mid 30s. Chit was tragic. But it was fear – fear of dying, fear of stigmas, fear of prosecution for non disclosure, fear of never secksing again that I honestly believed caused them to not want to know their status. They KNEW, but because they refused to confirm with a test, they went without treatment until it was too late.
I say that to say, well really I don’t know what to say. I got sad and lost my train of thought typing the above. All I know is that I don’t trust NO ONE when it comes to my health. We could get tested a thousand times and Im still giving the side eye to unprotected secks. Husband or not.
Oh and we all know them cats that try to raw dog you the first time so

How can you punish someone that has no “heart” to do something like that… even for murderers or rapist or anyone that shamelessly do unjust to others?
Have you watched some of those real life behind bars show and seen some of those heartless animals? They are dead in the eyes and do not care what man or government does to them… Killing them is way too easy for them (in my eyes). Like I said it may have to do with where I am in my life emotionally, spiritually and such that I have that outlook.
Let me add this, maybe I have always been a passive person and alot more now as I get older and understand more. But one day, I was at Costco and I had my 3 little ones with me ( normally I do not take my smaller children with me to go big grocery shopping but it was a last minute decision) well we were coming out the store and Naaj was walking next to me and the other 2 were in the pulley cart… well this lady drive basically almost ran her car into us… There were not even enough room to put a finger between the car and my daughter. She was that close and alot of people around basically attacked her for almost could have possibly killed us. But I was not angry… I was more grateful that we were okay and me and my babies could go home.
I just try not to look at the negatives in a situation (if I can help it) but the positives/ blessings and saving grace in all of my life… I do not know how long I will be here. I just want to enjoy the life I have now with my family, babies and friends. I do not have time to think about the negatives in situation (if I can help it)…. I will keep being thankful for the moments I have and when I am gone it will be the end of it until judgement day (which is another story).

@Ya’ll – Yes, fa real. I start itching and in need of icecubes, cold water and monistat. I can use microsheer condoms or abstain. Thankfully I’m commited. Birth Control pills made my pressure high and I tried the sponge and the film and it too made me irrtiable. My Goodies is ULTRA SENSENTIVE. #Dont Hate

Some people tell me I am too soft but that is not it. I just have learned to pick my battles quite well to keep my sanity. I am quite the optimistic person too and can take a beating but I have learned to love harder until I truly can not take anymore then I will let go.
Well I was just happen we were alive. I saw the fear in her eyes and understood it was a mistake but it was not enough for me to get upset over when I got to go home to my other 3 babies. My biggest fear is leaving them and feeling like I did not prepare them enough to live without me… I believe in the MOST HIGH and always ask for him to give me peace in knowing that I have done my best with my babies and they will be okay if I have to leave unexpectedly. I am graceful I come from a family that will do their best to make sure my babies are ok.
I am not saying I want these people to drink Iced tea and chill. Yes, maybe someone else have to decide what punishment they get because I could not after the anger subdued. But I look forward to when the “REAL BIG ONE” lays it on them really nice.

I know babycakes… I don’t judge her for what she believes. I just ask that whatever he is doing with her to forgive her and keep her safe. And when he is ready that he makes her a believer for that is what he promised to do… (make non believers, true believers). My heart is open to her for a reason and I listen to that inner spirit that guides me daily.
She is changing more than she realizes and that is exactly how it is suppose to be.. She is not a goner just misplaced for the moment. she is open to things for a reason… her understanding just has not come full circle yet.

Don’t listen to the naysayers… We all have roles in this world and yours just happened to be fruitful. You are doing what needs to be done so what others have to say is just their judgment and your blessings.
You work hard for yourself and your babies… you provide for you all…. protect and clothes them and most importantly you have instilled values in them so they when they are grown and have their own conscience they will make good decisions and be great individuals.
In the United States if a client reports to a therapist that they are engaging in unprotected sex while HIV positive mental health professionals are not allowed to notify authorities or the endangered partner. The premise is that just because you sleep with someone with HIV does not mean you will contract the disease, and because you can not confirm that the person will contract the disease it is considered non-threatening…
