Two women accused of shoplifting a Philadelphia 7-Eleven found themselves locked inside the store by employees.
Cell phone video from outside the store shows the two women yelling at employees to let them out. One girl starts kicking the door and taking items off the shelves and throwing them at employees.
By the time a lone police officer arrived and confronted the women, one of them got a little jumpy and swung on the cop. She was immediately thrown into the display shelf and body slammed to the floor.
The other girl tried to intervene by hitting the officer. Meanwhile, her friend — who must have been a wrestler in high school — rolled the officer over and starts punching and kicking him. He punched her in the face to subdue her.
By that time, four more officers arrived and helped the rookie officer handcuff both women.

I think you can detain them if they walk towards the exit. But they hv to actually see you take the item put it in your hand and they hv to see you conceal it. Because for a place like 7-11 you hv to be sure the person didn’t come in with it. I hv walked into Walmart eating some candy. I stopped turned around and said I need a sticker or something. I wasn’t walking all the way back to my car & I didn’t want to throw it away. Another example is I’ve seen a young guy walk in 7-11 he had a lollipop in his mouth and the clerk tried to say he stole it. The guy said What?! Man y’all don’t even sell these! I said I saw him walk in with it.

In Pennsylvania, the thief does not have to leave the premises in order to be arrested for Retail Theft:
Ҥ 3929. Retail theft.
(a) Offense defined.–A person is guilty of a retail theft if he:
(1) takes possession of, carries away, transfers or causes to be carried away or transferred, any merchandise displayed, held, stored or offered for sale by any store or other retail mercantile establishment with the intention of depriving the merchant of the possession, use or benefit of such merchandise without paying the full retail value thereof;”
They just have to take possession with an intent to deprive the owner of the merchandise. The statute also grants the retailer the right to detain the shoplifter:
“(d) Detention.–A peace officer, merchant or merchant’s employee or an agent under contract with a merchant, who has probable cause to believe that retail theft has occurred or is occurring on or about a store or other retail mercantile establishment and who has probable cause to believe that a specific person has committed or is committing the retail theft may DETAIN THE SUSPECT in a reasonable manner for a reasonable time ON OR OFF the premises for all or any of the following purposes: to require the suspect to identify himself, to verify such identification, to determine whether such suspect has in his possession unpurchased merchandise taken from the mercantile establishment and, if so, to recover such merchandise, to inform a peace officer, or to institute criminal proceedings against the suspect. Such detention shall not impose civil or criminal liability upon the peace officer, merchant, employee, or agent so detaining.”

I once had an interview with a retail store and they asked me what I would do if I saw someone robbing the store, I replied “hold open the door and help load the items in their car”. I didn’t get the job but why the hell would I be captain save some chips and dip and get hurt or shot in the process.

The Mexican food in Mexico — Before I went there everyone used to tell me there were no good Mexican restaurants in NY and I’d say, “You have no idea what your talking about. I know a ton of great Mexican restaurants.” Then I went to CA and we drove down to Tijuana and Oh. My. Lord.!! I was in beans and rice heaven. Seriously, I couldn’t believe how flavorful everything was. I literally felt like I was eating Mexican for the first time in my life. (Now I’ve talked myself into wanting a quesadilla.)

That was the one highlight of my pregnancy, everything else was horrible :(! I told my mom about the popularity of gender reveal baby showers and she was like WTH??? She was surprised during both of her pregnancies, girl first (me) then a boy! I wanted to do the same thing. Plus, it’s fun coming up with both boy and girl baby names. You’re definitely going to have a full house with baby number 3! I only have one, he just turned 2 and is a LOT to handle! I hope your pregnancy is enjoyable and that you have a healthy baby! I still want to go to Mexico, but even the Mexicans told me not to do it because of all the crimes that occur against American tourists there and they told me that I shouldn’t go alone if I do go. I went to Colombia alone and got robbed, but I survived and wasn’t harmed so no big deal. It did scare me, but I doubt I would be afraid to travel to Mexico because it depends on what areas you travel to, just like any country. When you’re a woman, men will tell you not to anything by yourself. I love traveling and doing activities alone, it’s therapeutic :).

NS, good point, buuuuuuuuut…Where a lot of retailers fail in the prosecution of would-be shoplifters is proving the “with the intent to deprive” portion of the law. The only fool-proof demonstration of “with the intent to deprive” is when the suspect leaves the premises. Not before. Period. All 5 elements of larceny have to be in place…the final one being: leaving the premises. She hadn’t left.
I’m trying to hold strong but I don’t know if we can make it through the anatomy scan without caving in. You are not alone, pregnancy brings all kinds of emotions, even though this is your third baby. One minute you are anxious, then depressed, then you seem okay. Some women love being pregnant, I still don’t know how or why. The best part is meeting your new little one, but I would never call pregnancy a joy, but it is a blessing :). I’m still up right now because my 2 year old won’t got to sleep :(. He fights sleep just about every night and prefers to sleep in my bed! I will be glad when the toddler phase is over. And people think I want to go through this again to give him a sibling. Naw, I’m good! LOL!
Usually Walmart doesn’t say anything about things like walking in with food. I walk in Walmart with snacks and drinks all the time and so does my baby. I even open up snacks sometimes when I’m in the store and eat them, of course I still pay for them afterwards :). Walmart is like a second home to most people. I do all sorts of things in Walmart and no one says anything. I even go in the back to get things if I don’t see it on the shelf! Yes, I go in the fridge/freezer and get my damn milk because they often forget or don’t want to replenish the milk shelves! The nerve! It’s cold as shit back there! LOL! Brrrrrrrrr!!!

You’re confusing common law with codified law, which I used to do myself when I was a young law student many, many, many moons ago.
You would be correct if this were general common law, but it isn’t.
It is the codified law of Pennsylvania. In establishing their civil and criminal codes each state legislature takes the general common law, then sets specific codes for THEIR particular state (codification). The above statute is Pennsylvania’s codification of the general common law of larceny, and leaving the store is not an element of the crime in PENNSYLVANIA’s state code. If it were, then the statute would not give the merchant the right to detain the suspect ON THE PREMISES, which it does under section (d). If leaving were an element, the statute would only give the merchant the right to detain OFF the premises.
In Pennsylvania, the suspect merely has to ” take possession” with an “intent to deprive.” That element can be met if the young woman took merchandise and concealed it on her person, in her purse, in a bag, etc. Concealment would have established probable cause and given the merchant the right to detain. The statute clearly states that a merchant:
“may detain the suspect in a reasonable manner for a reasonable time ON OR OFF the premises…to determine whether such suspect has in his possession unpurchased merchandise taken from the mercantile establishment and, if so, to recover such merchandise, to inform a peace officer, or to institute criminal proceedings against the suspect. Such detention shall not impose civil or criminal liability upon the peace officer, merchant, employee, or agent so detaining.”
So not only can they detain ON tbe premises. but the statute specifically protects bim from either civil or criminal liability for that detention so long as probable cause was present.
