Popular YouTube influencer Kayla Nicole Jones filed a lawsuit against music producer Polow Da Don, alleging breach of contract and breach of fiduciary duty, among other complaints.
According to court documents obtained by Sandrarose.com, the plaintiff allegedly began a sexual relationship with Polow, real name Jamal Jones, when she was only 18.
The plaintiff was 17 when she created her YouTube channel, Nicole TV, which grew to over 5.4 million subscribers.
Nicole released her song, “Late Nights” in 2019. The song created a buzz and attracted the attention of Polow, who sent her a DM about helping her career in the music industry.
During intimate pillow talks with the teen, Polow allegedly discussed terms of a recording agreement (Agreement) between her and Polow’s record label, Zone 4.
Zone 4 was also named as a defendant in the lawsuit.
On the night before signing the Agreement with Zone 4, Polow allegedly spent the night with Nicole.
The next day, September 19, 2019, Polow drove Nicole to his recording studio where he illegally plied the underaged girl with alcoholic beverages while continuing to discuss the terms of the contract.
When the teenager asked Polow if her manager could review the Agreement, Polow allegedly refused and insisted that she sign the Agreement immediately.
She expressed concerns about sharing her YouTube revenue 50/50 with Polow. After much debate, she signed the Agreement, agreeing to keep 85% of the substantial ad revenue from her YouTube channel.
The complaint alleges that the teenager was “intoxicated” and she was not represented by an attorney at the time she signed the Agreement.
The complaint also alleged that Nicole was not paid an advance by Zone 4, and Polow eventually lost interest in her career after their sexual relationship ended.
Nicole wants relief from the court by releasing her from the Zone 4 Agreement. Additionally, plaintiff is requesting reasonable attorney’s fees and expenses of no less than $25,000.
A judge granted a stay in discovery so the two parties can negotiate a settlement. The discovery stay ends next week.
