Actress Halle Berry went back to court to apply for a temporary restraining order against her baby daddy Gabriel Aubry following the underwear model’s fisticuffs with her fiance, Olivier Martin.
The fist fight occurred on Thanksgiving day when Aubry arrived at Berry’s home to drop off Nahla. The two men reportedly exchanged words in French before Aubry battled in the driveway. It isn’t clear if little Nahla witnessed the knock-down, drag-out fight between the two men.
If the restraining order is granted, Aubry, 36, could lose joint custody of their daughter, Nahla, 4. The TRO could also pave the way for Berry, 46, to move with Nahla to France, where treatment for autistic children is more advanced than in the USA.
Aubry allegedly threw the first punch. But the stronger Martinez flattened Aubry with one punch and pinned Aubry down in the driveway. The French actor made a citizen’s arrest on Aubry, who was then taken into custody by arriving LAPD officers. Aubry was later released on $20,000 bail.
Both men were treated and released from a hospital. But photos that surfaced in the days after the fight showed Aubry, 35, with a huge shiner under his right eye and other injuries.
In January Halle’s nanny accused Aubry of assaulting her when she arrived to pick up Nahla after a court-ordered visit. A judge later denied the nanny’s request for a restraining order on Aubry.

I agree with whomever said that Hallie used Gabe as a sperm donor. It was obvious when she got pregnant. She wanted a child for years and picked out an exceptionally good-looking man to use as a sperm donor. She should have adopted like a lot of other stars have done (Sandra Bullock, Charlize Theron, etc).
I guess she thought that she could do a Madonna. Even in Madonna’s case, as her daughter got older she wanted to know her father and they have a relationship.

i don’t think he’s going to retain custody. he can’t seem to see the forest for the trees. he puts his own feelings before nahla’s when he’s fighting in the damn driveway. either nahla is saying or doing something that’s putting him over the edge or there will be endless fist-fighting and verbal violence as long as he has custody. fighting through the courts is the only way.

A close family friend recently told media sources that Halle and Gabriel are being investigated by CPS following the fight that took place between Aubry and Martinez. Radar Online reports,
“Detectives from the LAPD formally contacted CPS after Gabe’s arrest, because Nahla was present when the fight occurred. Nahla wasn’t actually involved in the melee, and by all accounts, Halle whisked her out of the driveway as soon as the fight between Olivier and Gabe started. However, DCFS was contacted because there has been a history of allegations of physical abuse. Social workers will be interviewing Halle, Gabriel and Olivier about what happened on Thanksgiving. DCFS must ensure that Nahla’s environment is safe.”
