Denver Broncos linebacker Von Miller sued a former sex partner to block the sale of a sex tape, The Smoking Gun reports.

A Los Angeles Superior Court issued a temporary restraining order barring one Elizabeth Ruiz from selling, distributing, copying, or releasing the video recording.

Miller was rumored to be dating pseudo singer K. Michelle.

The tape was recorded while the 27-year-old Super Bowl MVP vacationed in Mexico over the summer.

In July, Miller signed a six-year, $114.5 million contract with Denver, making him the NFL’s highest paid NFL linebacker.

In June, Miller, a couple of male friends, and a handful of groupies flew to Cancun, Mexico.

According to The Smoking Gun, Miller rented an 11,500-square-foot beachfront residence for himself and his friends. Instagram photos show Miller, Ruiz, and the other groupies riding jet skis, parasailing, and relaxing at poolside.

At some point, Miller and Ruiz retired to a bedroom to have sex. Ruiz recorded their intimate encounter with her cell phone, prompting Miller to stupidly ask that the recording be kept private.

“Ruiz agreed that she would keep the recording private,” Miller’s attorney noted in court documents.

Upon returning to the U.S., Miller reminded Ruiz that “he did not want anyone to see the recording and asked Ruiz to erase the recording.” Ruiz responded, “Gotcha,” according to the petition.

In mid-September, 2 months after Miller’s record-breaking contract was announced, Miller was contacted by a L.A. man named Kevin Blatt who brokers deals for celebrity sex tapes.

Blatt told Miller that Ruiz asked for his assistance in selling the tape to the highest bidder.

He added that Ruiz wanted to become the next Kim Kardashian, a reference to Ray J‘s sex tape that made the socialite and her family Internet famous.

In early October, Ruiz dumped Blatt and retained a lawyer named Corey Boddie.

Boddie sent a letter to Miller and his attorneys advising them that he was representing Ruiz, who wanted $2.5 million “to transfer ownership of the recording” to Miller.

Court documents describe Ruiz as an extortionist who “desperately craves fame and fortune,” she is “willing to settle for fortune if she could not also achieve fame.”
