An American Airlines passenger is suing the airline after he was kicked off a flight so a dog could sit in his first class seat.

Dana Holcomb, of Killeen, Texas, was returning to Austin after a 53rd birthday celebration in April.

As he boarded the plane Holcomb noticed the passenger sitting next to him had her pet - a comfort dog with her.

Holcomb, who is allergic to dogs, immediately began to experience allergy symptoms.

The pet owner offered to switch seats, but no other passenger would give up their seat.

The flight crew and captain offered to move Holcomb to the back of the plane, but he declined.

Tensions flared and surveillance video shows the captain pointing his finger in Holcomb's face.

The airline would later accuse Holcomb of causing a scene and being uncooperative. But two witnesses disputed their side of the story.

Holcomb was kicked off the flight without his luggage or allergy medicine. He was not offered a connecting flight or hotel accommodations, according to his attorney.

He booked a hotel room at his expense for the night, and he caught another flight home the next day.

Holcomb filed a lawsuit against American Airlines for racial discrimination and infliction of emotional distress. "To be honest, it made me feel that I was less than a dog," he said.

"Dana was taken off a plane so a dog could fly first-class cabin," his attorney Reginald McKamie, Sr. told reporters, according to ABC affiliate KWTX.

"What American Airlines is doing is discrimination," McKamie said. "They have repeatedly humiliated African American citizens by throwing them off the plane, leaving them with no way home, no hotel, just throwing them off the plane."

American Airlines spokesman Curtis Blessing said Holcomb was offered a refund which he refused.

"They were then offered a seat in the main cabin to provide additional separation and were offered a refund for the difference in their first-class fare but also declined and remained confrontational," Blessing said in a statement.

An attorney who was in first class disputed the airline's version of the story, KXXV reports.

Jay Youngdahl, who is an executive platinum member, said he overheard the captain say Holcomb was likely to be a "danger" to other passengers and crew.

Youngdahl also said the captain invited the young woman and her dog into the cockpit before the flight, which is against FAA regulations.

As the story went viral over the weekend, American Airlines spokeswoman Lakesha Brown reached out to The Root late Monday night with the following explanation:

"Federal regulations require American Airlines to transport service and support animals. American makes every effort to accommodate all passengers, including those traveling with and seated near service or support animals. In the case of an allergy, we work to re-seat a passenger further away from the service or support animal.

Mr. Holcomb's seat was next to a customer with an emotional support animal. In an effort to accommodate Mr. Holcomb, the customer with the emotional support animal offered to switch seats with another customer so Mr. Holcomb could remain in his seat. Mr. Holcomb wasn’t satisfied with that solution, so he was given the option of a seat further away from the service animal in the main cabin with a refund in the difference in fare, which he also declined.

After all the attempts to accommodate Mr. Holcomb were declined and he refused to comply with crew member instruction, he was removed from the plane. Our team offered to rebook Mr. Holcomb and refunded his first-class ticket. American has not received [a] lawsuit but once we do we will review it and respond in court when appropriate."

    Had a Rose here, a very regular one at one time actually, that told us we needed to be more open to people flying with their animals...and WE are the ones who needed to adjust. Even the ones with allergies. Bc dogs have rights.

    I'm disturbed by this new trend of "emotional support animals" - I work at a hospital and it's AMAZING how, at one point, animals in sterile environments was an issue and now, suddenly, I'm forced to sit next to Lerlene and her emotional support cat while I eat at a restaurant.

    The majority of these MFs are simply animal lovers who want to take their pets with them to work, the grocery store, the doctor's office and, the mall. WTF were you doing to be "emotionally supported" prior to doctor's handing out prescriptions for take your dog to work everyday day? It's funny how you can take your a$$ to happy hour and leave Fluffy at home. You can go out on a date and you don't NEED the support of King. You take your a$$ on the job INTERVIEW without your mule, but when you get the job, you can't type without him under your feet... You can go to your friend's dinner party where she doesn't have dogs and leave Tippy's a$$ at home... but when you come to public spaces where you invade other people's space, you can't do it without Fluff.

    How were all of these people making it in the real world without their dogs prior to the last three years?
    Not all people are milking this, but I feel like MOST of these people are full of $hit!

    You literally just need a doctor's note. lmao. The note just says you have some sort of emotional or psychological disability (can literally be anything from anxiety, to depression or full-blown psychosis) and the doctor has 'prescribed' you to use an animal for emotional support. No proof of the actual diagnosis. No explanation of what 'support' even means. No details on how having the animal actually helps you. No restrictions on what type of animal. Just.. literally... a doctor's note.

    I'm tired of people with emotional support animals. When checking in a hotel this lady had a big ass emotional support dog and there was a guy who started wheezing because he was allergic. He just gave up walked out not sure if he ever came back to check in. Why does emotional support outweigh someone's health and wellness? This is getting ridiculous. On top of it the heffa just stood there said "I have my documents he's my support dog" ain't say a peep else, probably would've let the man throat close up and die and would've saw no issue on her end. It's honestly selfish as hell, why get on something meant for everyone with something that can be harmful to others!

    My niece doggies LOVVVVE the kennel. Never mind it costs a million dollars a day to have them there lol. But no the poster didn’t seem to care (I wont even say didnt understand bc she is smart as a whip) when folks were saying its nothing against dogs. Some people cannot be around them.     Sometimes a certain airline is your onliest option. I live in a capital city and our air choices have just RECENTLY improved. Recently like past 3-4 years. Previously you might only be able to get say an Southwest flight to XYZ unless you get in your car and drive 3 HOURS to Charlotte to fly out of there or 3 to Richmond. What is your solution to instances like those? Bc I was the person booking travel for a whole team of reporters, mainly sports reporters who had to go all over these United States to cover the Tarheels, Blue Devils, and Carolina Hurricanes.

    I was in Lenox Mall in Atlanta on 9-1. Someone had a 10-12 pound dog in the mall taking a dump about 30 feet from the Godiva Chocolate store. The owner didnt have any paper, so he just left it. Literally 10 seconds after he walked away, an Indian woman with two kids in tow rolled her stroller through the mess. I walked into the apple store and someone has a 45-50 pound pit with her, laying on the floor.

    I love dogs but it's become ridiculous. Leave your pets at home.

    My wife had a dog snatch her burger off her plate, and the owner pretended not to see. When confronted, the owner blamed my wife and refused to pay for the meal, getting up and walking away. The restaurant comped, although they weren't terribly apologetic.

    I scanned a hand full of comments so I already know no one agrees with me.

    Properly trained service animals and emotional support animals are invaluable to their owners. They have literally saved thousands of lives. Who can afford to have a human caretaker with them 24/7? This is a feasible alternative to that.

    That being said, I 100% believe AA's handled this poorly. I don't understand why they attempted to move him to the back of the plane and not her. I think they should have a system in place where they alert, at a minimum, the passenger that would be sitting next to the individual that is bringing a pet on the plane. I say pet intentionally, because anyone who is willing to pay, can bring their cat or dog on a flight. So, if you have allergies you should already be aware of this and plan accordingly. For example, I have a severe allergy to cats. Since I know cats are allowed on the plane, I am not angry or surprised if I see a cat.

    P.S. I look forward to them receiving a FAA fine.

    Furthermore, the doctor's note does not make restrictions - which is what I was talking about. It is the FAA that determines what kinds of animals can be emotional support. The note is specifically just says "animal" on purpose so the 'patient' can choose.

If you can go to the club and not require that same support, or come to the job INTERVIEW without it - that's very suspicious to me.

    Thats my issue. Its taking away from the ones who do need them bc you not gonna TELL me SIX people on this ONE flight need a support animal. I used that as an example bc my mom recently flew home from being in Bama with my sister and our fam for a month and she said it was SIX PEOPLE WITH SUPPORT ANIMALS on her flight from ATL to RDU. So in that vein I ALSO think it needs to be a per flight limit. We got 3 folks already booked. No more can catch this flight.

You're already accommodating THIS person by allowing them to bring their pet on the flight in the first place, you're going to accommodate THEM some more by putting ME in the back of the plane? Some people fly first class out of necessity... I'm SEVERLY claustrophobic - I can watch of MOVIE of someone trapped in a small space and hyperventilate... I may NEED that extra headroom and space on a flight. Why was it not too much to ask the person who has already been accommodated TO to make some accomodaTIONS?

    I've never seen an employee with an emotional support dog so I can't speak to that. I do know that when my mom was dying in the hospital a year ago one of the only things/people she could remember was her dog. The doctor suggested that I bring my mom's emotional support dog to the hospital.

    I guess it's a matter of perception. I have several family members that have benefited from support animals. Their issues were legitimate. I imagine people probably looked at my cousin (who passed as well) and probably assumed she was faking since she was young and often laughing and joking despite her many health ailments.

    I think there are some changes that could be made procedurally, but in principle, I don't have an issue with support animals.

    It is statistically proven that Black people are least likely to be open or aware of mental illness - which is a problem and is something that should continue to be talked about instead of shamed away as anti-black.

    People who must have service animals need to have separate flights period. Everybody don't like animals, plus you really don't know how just clean they are/due to how often owner may bathe their pet etc. It's unfair to have people who don't like animals stuck with them. You have dog parks, daycare, pet friendly restaurants etc. Let them have their own flights. I only fly 1st class anytime the flight is 4hrs or more. Too pay as much as I do to fly to London 1st class I AM NOT SITTING BY A DOG/CAT/RAT/BIRD/ OR ANYTHING OR HAVE THEM IN THE CABIN WITH ME.

My sister has a emotional support puppy but even she speaks of the volumes of people who go to great lengths to have their pet certified as a service animal just so they can be next to them on the plane, they are perfectly fine no pet support needed.     No it would not to market and advertise a flight catered to people with pets and I'm sure they'd put extra things in there pets need. My sister and neighbor who LOVES PETS TOO DAMN MUCH have emotional support pets. They said they wouldn't mind..this has long been a disscusion. Plus it's a come up for a the airlines. I'm a director of a school that caters to children with Autism, ADHD and delayed learning part, long story short we want to take them on a trip on a plane. THEY CAN NOT ALL GET ON A PLANE WITH LOUD PEOPLE, PETS AND OTHER THINGS....2 families have offered to purchase all of 1st class. I have spoke with the airline and they are doing their best to accommodate us. No pets nor other people in the cabin. Nobody said put people with pets on a plane that's about to fall apart with dog shyt on the seats and no flight attendants.

    I have 2 Boys worked for the airline for 10 years b4 a career change. Anywhere I go car ride or flight I pack plenty of snacks, toys, and the devil play doh keeps them quite the entire trip.     I would sue too!! The public's obsession with dogs these days is out of control!! People want to personify their dogs and appoint human rights to them at the expense of real humans. I can't even count the amount of times I've encountered people walking their dogs on these long ass leashes on crowded streets taking up the entire side walk and expecting everyone to move around and damn near walk in traffic to accommodate their animals preference for strolling. As for American Airlines, the dog should have been in a cage in cargo!! If airlines want to be accommodating, they should build special cargo areas for pets that offer a decent level of comfort.     True indeed. Sad thing is, this type of treatment by airlines is not just a black thing. The FAA has basically given flight attendants and airline employees absolute rule and authority to be discriminatory on flights. Which means if they "ask" you to do something, you basically don't have a choice but to do it. I've seen white people get bumped out of their seats for no reason and then get threatened to be kicked off the flight when they challenged the decision.

    Alot of people have pet allergies. That's why carpeting, flooring and air filters filter for pet dander. They suffer insilence because of the crazy, selfish, entitled, irrational, pet owners that refuse to be considerate. Most people just get allergy shots or live off the allergy medication. I refuse to do that because research shows that long term and daily use of these medication can lead to dementia all kinds of other illness. What about people with a phobia of fur (Doraphobia)? I have a paralyzing fear of fur and if a mouse or some other creature touches me, then the air Marshall would have to shoot me because I would shit myself.

The industry needs to decide what they are going to do with pets. Right now they are allowed and people need to decide if they are going to fly with the potential of having one in the flight. He is allergic to dogs. She needs hers to fly. As far as I'm concerned it's a push. People with issues need to make arrangements with the airline to ensure they will be taken cared of by the airline.

    If he truly caused a scene was uncooperative and confrontational he should have been asked to leave the plane. The fact that the pilot got involved says it all. I totally understood his frustrations and he should not have been inconvenienced but at the end of the day the other passengers safety is priority. I don’t want to fly with anybody that heated in my cabin. They tried accommodating him and he refused so what now? If no other options he should just remain there being uncooperative?

    I think when ADA extended rights for pets to fly, more people identified as in need to require their pets with them. The airline is trying to accommodate but that involves disruptions to others. They have to address the issue.
    Before ADA folks did not have dogs in flight. Peanut allergies and their manifestation in flights was unheard of. People going crazy in flights (you seen videos) was unheard of. Now we have all three as a daily occurrence and three is loss of control. Not to mention the abuse some sustain at the hands of the TSA. I really don't know the answer other than careful planning by the airlines and passengers ahead of time.

    For everyone saying prepare for a pet to be onboard truly dont get it. Moving seats might not have helped. I have severe allergies to the point of Epi Pen. I can avoid my food allergens which are worse than my environmental ones. A person truly allergic cant avoid dog hair flying around the cabin for the next 2 hours. Only preparation some can have for a surprise dog is an Epi Pen. You ever have to use an Epi Pen? Let me tell you, if no? Its absolute hell afterwards. You are shaking. Vomiting. Clamy. Heart racing.     This was going to be a no-win for the airline. No matter what they did It was going to either be racial and allergy sensitive discrimination or disability/emotional support dog discrimination. If I had a severe allergy and was showing symptoms of an attack, I would have taken a different seat and/or flight with refund and accommodations. I'm not sure if they are telling the truth he was offered these options. Also, they violated protocol allowing the dog in the cockpit and not ensuring he was allowed his medication by keeping his luggage. I do wonder why he packed his medication in check-in luggage instead of a carry-on.

    Allergies are covered under the American With Disabilities Act. Problems result when one disability “trumps” another.

    I am allergic to dogs and other animals. Just switching seats is not enough to prevent allergy symptoms. I take 4 medications, carry epi-pens, and wear a mask. I still suffer symptoms.

    Not only that, the planes do not have HEPA filtration systems. Vacuuming stirs up dust for 2 hours.

    I am also terrified of dogs. What about airline passengers with animal phobias in need of emotional support?

I suggest you send the bill for your allergy medications, surgery, nasal spray, etc. to the corporate headquarters of the airlines, restaurants and stores that subject you to pet dander and set off you allergied. Tell them you want compensation because you suffered an injury on their property due to their negligence of not removing well known allergens from the public. They need to start displaying signs just like with the peanut allergies, saying pet dander is in the establishment. Sue they assses and they will stop. That pet dander is a dangerous a black mold to a person whose allergic to it.

Dept at the EEOC and file a compliant. Its negligence and disregard for others who have disabilties also. Not being able to breath is a code red level emergency. These anxiety filled nutjobs needs to leave their damn pets home. They don't want this smoke.

Hopefully me saying that didn’t sound like a excuse to support suing airlines and businesses, although, there should be rules and regulations to address certain matters! I mean, I don’t wanna eat food @ a restaurant or somebody else if they got cats on the counter or playing w their pets while ur making and servicing me my food

I’ve been to a bbq restaurant that had the smoke pit in the back fenced off, only thing is, there was I guess the cook dog out there laying down and a few Asian restaurants I’ve been to have had cats in and around the restaurant and that’s not a stereotypical joke, they were there!!     I would be SICK if I had to sit next to a dog. I am a little afraid of them... I never think that when flying my seat mate could be an actual animal.

    Redamndiculous! Why didn’t they offer her a seat in coach? First class ain’t cheap he paid for comfort if they were going to ask him to sacrifice they should’ve offered him a helluva lot more to move. American can afford a hotel room, a ticket to anywhere and a full refund. Especially to avoid a lawsuit! Good for Dana I hope he gets PAID!!!!
