Fulton County District Attorney Fani Willis responded to media inquiries after she dropped attempted murder charges against drill rapper Lil Durk.
In a statement issued to WSB-TV reporter Michael Seiden on Monday, Willis said, “This office has declined to indict Derrick Banks, a.k.a. “Lil’ Durk,” for the February 5, 2019 incident because insufficient evidence exists to prove his guilt beyond a reasonable doubt at trial.”
Investigators had surveillance video from two businesses showing Lil Durk, King Von, and two other men shooting at the victim, Alexander Weatherspoon. Weatherspoon survived the shooting.
“You see Mr. Banks’ arm out the window firing several shots at the victim,” an investigator testified in court in May 2019.
Only in Atlanta is video footage of a violent crime considered “insufficient evidence.”
Surveillance video also captured Lil Durk fleeing The Varsity parking lot in a grey SUV wrapped with a giant red “300” logo.
300 is a Black Disciples street gang in Chicago.
King Von was later killed during a fight outside a hookah bar in downtown Atlanta in November 2020.
The other 2 suspects, drill rapper Hellabandz was killed in Miami Beach in May 2019. And drill rapper Zoo is in a Chicago jail awaiting trial on weapons charges.
