An off-duty police officer is seen on a convenience store video shooting dead two would be robbers while holding his infant son. Sergeant Rafael Souza’s wife was with him in the pharmacy in Brazil when the robbery attempt went down.
Souza reacted quickly by shooting the two robbers before handing his son off to his wife.
PIX 11 reports that one of the suspected robbers pointed his gun at Souza who fired multiple shots while holding his child.
Souza reportedly told investigators he fired his service weapon because he feared the two suspects would shoot him and his family if they identified him as an officer.

What’s a “would be robber”? This guy is all over the place acting reckless. He almost shot the guy in the white. Also, you’re supposed to identify yourself as a cop anyway before you start popping off. If he didn’t identify, their families may have a suit but it’s Brazil, don’t know how they get down over there.

I don’t think he needs to inform anyone he is a police officer. If someone is pointing a gun at me and my family and I am licensed to carry,it doesn’t matters who you are you are allowed to protect yourself and family.
Why would his family have a suit if he didn’t identify himself? Anyone who is legal carry has a right to protect themselves and family especially if someone pointed a gun at them.

Because as a cop, it’s required for you to identify yourself due to the authority you hold and the “higher standards”. Hopefully they have more videos than that too because the only person I see with a gun pointed is the cop.
What l dont like about the police is they need to police themselves and many a corrupt politician and white collar criminals need to be shot dead but they just have a hard for blue collar crime
I am here in Brazil and it is crazy. The police ride around with guns out and ready at all times, even on the motorcycle the riding behind has his gun in his hand and finger on the clip. At first I was shocked, but I see why.
So he is suppose to stop in the middle of a situation and announce he is a cop? “Wait don’t shoot me or my family I must announce I am a cop first” that isn’t how any of this works at all. He could have said police put your gun down but doesn’t have to when he is a citizen acting in self defense.
So many crimes in Brazil I believe they instruct the police to shoot on sight.
Yes, he was supposed to say “police, drop your weapon” or something to that effect. Police are on “duty” 24hrs, there is no “doesn’t have to when he is a citizen acting in self defense”. Just like other public servants, they don’t get to choose when they want to be “just civilian” and not abide by rules (identifying/showing badge). They should actually take MORE precaution when in civilian clothes to prevent murky situations. If “would be robbers” weren’t killed, they could say they didn’t know he was a cop, and that the cop pointed his gun at them and they were defending themselves. That’s why I say, hopefully they have more videos with different angles.
Actually according to Gibson v the city of Chicago an officer an act under the “color of law” or as a citizen. The difference is when acting under the color of law the law enforcement would be held accountable for the actions of the office but he can act as a citizen as well… they do not have to be a police officer all day every day ad a law enforcement officer my self and the sister in law of a police officer there is a big difference.

What does color of law has to do with this scenario? “can act under (color of law) or as a (citizen)”. Color of law is basically officers, uniform or civilian clothes abusing people’s rights.
Here is the definition of acting under the color of law “The act of a state officer, regardless of whether or not the act is within the limits of his or her authority, is considered an act under color of law if the officer purports to be conducting himself or herself in the course of official duties.” It is exactly what I am talking about acting under the color of law is acting as a police officer but anyone had a right to defend themselves when a gun is pointed at then. He does not have to identify himself period when he is acting as a citizen.

Yes, a very dangerous country. But it is very beautiful, I just wouldn’t feel same there. I know a lot of people who like to go to these “dangerous countries” and end up with sob stories of being robbed or nearly killed or scammed. If you are rich, or famous like say Rihanna – you’ll have no problem touring the country. But if you are a regular Jenna or Joe, it’s like – be very careful where you tread.
