A Maryland mom and her brother face 2nd degree murder charges in the beating death of her 9-year-old son.
Police say Oriana Garcia’s boyfriend Robert Leroy Wilson, 31, beat Jack Garcia nearly to death for eating a piece of birthday cake without permission.
Garcia’s brother, 23-year-old Jacob Barajas was also charged with 2nd-degree murder for handcuffing the boy to a bed and leaving the bedroom.
Police say 26-year-old Garcia and Barajas beat and tortured little Jack in the past.
After Wilson left the home to pick up Garcia from work, Barajas called 911 on June 30 to report a child was having difficulty breathing.
Emergency responders were met outside the apartment by Oriana Garcia who told them her son was simply “congested” and didn’t require treatment.
4 hours later, someone called 911 from the home on the 500 block of Lynne Haven Drive. This time paramedics were allowed inside the home where they found the 9-year-old boy “unresponsive and not breathing.”
Jack died 5 days later.
On Thursday, Oriana Garcia pleaded not guilty to 2nd-degree murder and first-degree child abuse charges. She denied watching her boyfriend beat the boy. She is also accused of denying Jack medical treatment.
All 3 adults lived in the cramped apartment with Jack in Hagerstown, MD. They allegedly forced Jack to overeat until he was “sick of it.”
Wilson’s bail is set at $1 million.
